Your theory is interesting. But if true, the result should not be an image out of focus but an image with horizontal lines (like when you take pics of monitors).
Maybe seagulls are not out of focus but blurred.
They move quickly quickly quickly when feeling that you are taking the picture so they result blurred ;)
What about this theory?

I have lots of seagull photos in great positions, but they are all slightly out of focus... I just think it is a seagull thing and that they only give an impression of clarity by flashing like a television at 50Hz.
